Because those fringe groups like RSS, Shiv Sena and VHP which involve in these kinds of troubles would be banned and disbanded just like their Islamic counterparts instead of being actively encouraged. Islamic outfits have been rightfully banned for much less incitement and violence than RSS or Shiv Sena indulges in. So why is it that these groups are allowed to operate out in the open without repercussions and especially during BJP rule and BJP leaders try to justify their actions. Leaving aside the fact that Shiv Sena nothing more than a rowdy Sheeter gang that does as it pleases in Mumbai that other places that they operate in, RSS is one organization that has been involved in trouble making and associated with serious crimes including assassinations for a long time.
Congress was no good and they didn't care about anything other than filling their own pockets. If BJP claims that they are any better, what's stopping them banning these terrorist elements instead of trying to support them. Religious fundamentalist groups and other outfits that that use the religion labels should be banned indiscriminately regardless of their representation as they are the bane of the country.
Secondly, judiciary doesn't decide whether a crime has been committed. they just decide whether there is any legally acceptable evidence still available. They are not the same thing and that is why our Politicians never got punishments regardless of the crimes they were involved in. Somebody can go Scot free despite involving in a massacre due to lack of evidence. By your logic of judiciary collaboration, Hafiz Saeed and Lakhvi are also innocent people because the Pak judiciary did not find satisfactory evidence against them.

Firstly, please consider both sides of the coins before jumping on to such biased conclusions. So let me enlighten you a bit about RSS, and I quote:-

Shakha’, which is the basic unit and activity of RSS. There are no fees and no typical registration process. Once you start attending Shakha, you are considered as a member.
Not just Hindus, there’re Muslim and Sikh members too!
Some people wrongly assume that RSS is against every other religion but the reality is that the organization treats Muslims, Christians and everyone else in India as cultural Hindus. Anyone can become a member of RSS, till the time they believe in India’s sovereignty. What is wrong in that?
The charitable pursuits of RSS and Sangh in J&K, especially for building a better future for children have always remained buried...and many more of such feats.
PS:- I have deliberately copy pasted facts to make people truly aware of the intentions of the whole group. One should not make judgements based on actions of few individuals.
Now coming to your point 2 about the veracity of court judgements of our nation. Your point about the Indian judiciary points to your ignorance about our Indian political system. Our polity at a fundamental level consists of three independent bodies I.e. the executive, the legistalive and the judiciary. These thre branches have separated powers. If you look up at recent news articles, you would come to know about a collegium system of judicial appointments which is completely free of political interference. They even shot down the NJAC( National Judicial Appointments Commission), thus maintaining the independence of the judiciary. I don't know about Pakistan, but in our country, you can be rest assured that the courts and superior courts have complete independence of taking decisions. And all the judgements are passed after complete scrutinization and thus you can be sure about their accuracy. And oh, if you claim that RSS indulges in anti social activities, why don't you stand in the witness box and give tangible evidences.
Lastly please don't fall prey to the views of presstitutes and sickulars. If you can't make a judgement, atleast don't blame the courts of the same...
