Can I sue Tikona for harassment?

Looks like Tikona has a bunch of angry customers here also. I really am gonna file a case against them in consumer court. just praying the court is effective and dont take years to deliver justice. Damn ISP's and their shitty services.
 
LOL who gets scared of these Tikona clowns? Same thing happened at our place some 4-5 years back, i remember they used to call again and again and i explained them 2-3 times after that i abused every time they called didnt matter if it was some court case threat or local goon threat, the constant bile and abuse solved the problem.
 
All lies when they say they call from advocates. OP Just don't give them a cheque which bounces. If it bounces they can legally screw you.
Still using tikona. But a few months ago, my account got suspended due to non payment. I was at home and got a phone call. Truecaller showed Tikona Care in Mumbai. Well, I picked up and was amazed of what happened. I'll tell you what he said:

Guy: Mai advocate (some shitty name) bol raha hu Delhi supreme court se (yes,supreme). Aapka tikona ka bill 2 mahino se pending hai. Tikona ne aapke naam pe case kiya hai supreme court me. Issue legal ho gaya hai. Aap phas gaye ho.

Me: (I knew he wasn't an advocate since truecaller showed as a Mumbai number and he claims to be calling from Delhi)
Me: Acha thik hai. Toh muje ab supreme court aana padega? Thik hai. Ek flight ka ticket book karde aur mai aa jata hu. Late mat karna, mere naam pe Mumbai me bahut cases hai. Sab attend karna hai.

Guy: Advocate se aise baat karte? Tumh....

Me:Abe ch*t**e, (and a few more words you don't wanna know), tereko jo karna hai kar. Tere sanpada office (tikona's billing department in Mumbai) me aake tereko batata hu. S**le, kya samaj....

He then hung up the phone.
So yeah, this is how cheap tikona executives are.
 
Stop replying. Ignore their calls. if they say that they have lodged a case in Delhi court tell them to send the summons. Trust me, no one will entertain a case for less than 4000/- The judge itself will throw the case out saying that stop wasting our time. Since you no longer stay at the place where u had the net connection, let them go to hell. If you feel like... sell their equipment on OLX too :p (kiddin)

P.S. I submitted my TATA Indicom router like 6 months ago. I did not get my security deposit refund yet. I don't care. Good riddance I say !!
They don't even go to the courts. Caller claiming to be advocates are simply lying. Its a threat, some people buy it and get scared. I used to get calls like these and naughty me I used to pretend I got scared. So I used to say "please court mein mat bhejo case, main phas jayoonga etc" they suddenly "summon bhej do" or "Kanse chamber mein bhaithe ho supreme court mein?" All the times the caller hung up.
 
So I'll just ignore them?
What about the equipment? :|

Wait for the summons or any kind of notice from Tikona OR contact any Advocate and tell him about your situation and ask for a solution.OK. If the Advocate says just ignore then you don't have to worry anymore.
Its better to be prepared before hand right. Its your call OP.

You can file a case for compensation only after the present case gets over.The Judge automatically will compensate you when everything is settled.

Ex: Say they claim that you have to pay them 2500 then if they lose the case then the Judge might order them to pay 2500 + interest to you.Ok.

Ignore. They're seriously not going to take any action on you for a small issue and amount such as this. They'd waste thrice that in legal fees and money.

I think I should contact an advocate just in case. I want to harass them instead of the other way round. how much do they charge? :|

Even Airtel does this.. This is how Indian companies work..

Develop some patience. Find ways to better use spam filter and someone else will suggest a workaround for messages.

Nope. They cannot do that afaik. A case is a case. I was about to fight in consumer court for 150rs.

lol, you seriously have a lotta time. BTW i had similar issue with reliance 3-4 yrs back. everytime they called I first interrogated them who they were, and to give me my complete account details, etc etc.. Mostly they would say they would callback getting all the details and then some other exec would call up. If someone was lucky to have my account info, I would give them my cancellation no. and ask them to confirm. Finally they got so tired, they just asked me to provide the CPE (modem) and they'll close the case. I kept their LAN cable as a penalty ;)

BTW I did get calls from so called advocates who happened to be standing outside the High court. And simply out of human consideration he wanted to call me:rolleyes:
 
OP, first you have to return the equipments yourself at their office and get an acknowledgement. (I am sure there will be some small letter agreement somewhere which says that as long as the equipments are in your possession you are their client and they can bill you. I am quoting a similar sounding text from Airtel's digital TV). Returning the equipments also puts you in a clear legal standing that you do intend to discontinue their service.
If the discontinuation does not happen and such type of threatening behavior persists then, record the call and file an FIR or at least a police complaint.

Also I am not sure if consumer court will help you here. AFAIK, they will tackle issues pertaining to deficiencies in paid services. Unless you can prove them that this is a deficiency in service.

Also don't be sure that it does not happen in other countries. It happens but in a different way. In USA when I called up AT&T to disconnect my broadband, the CS person told me to return the equipments at the nearest office without which they could not disconnect. I asked if they could pick-up from my place, as I had sold off my car by then, she replied in negative. I had to take a cab to the nearest office for returning the equipment

^doesnt really matter. I had a airtel hd tv stb and when they called me to return the equipment, I told them that I threw it away. in fact I opened the box to try some reverse engineering. it doesnt really matter. no one cares in India. I actually got many calls from so called lawyers from delhi high court. I politely told them to send me the court summons. never happens. no one in India got time for pursuing a court case for a friggin stb or any telecom equipment.

I will return the equipment. I don't even want them.
But one thing which I dont understand is why the hell they didn't come and take when i told them to and now wants me to return them when I'm out of station. In fact they acknowledged in one of their calls that I was out months ago. Morons.
