Customs - wont be at 7% of your invoice. It will be for 7% of the cost it is available at india i.e. around 3-4k

Importing used phone is not prohibited in India, you just have to import fee that's all..
Import it, declare it as used, let it enter the custom house, then let me know the results
if you don't agree with me, ask other members including @prateekS , he is regular importer of phones from US
Going by the rules it is not allowed . By the same rule Customs should be levied on the invoice amount .
