the seller is an expert in hardware & honest as well !!!

the product can be of good quality & serves my requirement

Now I regret that my above assumption (esp. later) was wrong

The Avermedia link that I have sent you says that it has FM ... I have never tried it.

TV reception is very good, cable is also excellent,

DVT reception is also good and I was able to check it as Delhi has DVT for Doordarshan

Warranty is not an issue as the product is never used, is lying brand new

..... I dont like returnig things ....

I have given you the details of the card .... so it will not be different. .......

Be sure it will make you happy if you take full use of it.

I was not able to check FM but I cheked tv reception, camcorder connection,

video recording etc and specially card compatibility with other hardware.

But Nano express card according to Aver ste does support many features including fm

that I cld not test. There is no software cd as it never came with it. I did not purchase

this card as a seperate item from a store. It was a bundeled package from Dell.

They have a agreement with Aver and they get the software customized according

to Them from Aver. Dell has the entire software of Aver that can be downloaded

from their support site. check here at http://supportapj.dell.com/....

the product has no software cd . seller told that all required software is available from

Dell support site and given a link . the link had a driver for his own system . I tried it ;

and used all known best applications to use the product . No use at all ; it didn't work :(

now he told that the product will work only under windows media center ...

I've windows vista OEM business edition . I do not have windows media center .

so I made extensive (re)search on the net .

now I came across many problems quoted across the net .

The seller himself had posted a review on Dell community site & the other forums .

now the interesting point to note is that seller reviewed the product in Jan 2009

where he said that the product is a incapable card & clearly mentioned problems

associated with it . where as he exagerated the capability of the product here

in March 2010 to sell it .

he lied when I queried about fm and recording quality . in review he wrote that specially the FM

radio will not work though the original card from Aver has FM features . this is clear cheating

I am fed up with the product as it doesn't work .

so requested the seller to take it back and return my money ( 13 Apr 2010 ).

now he responded that ( 19 Apr 2010 )

I am in no obligation to take return of the item as I never mentioned this is the trade as the card

is new and functional. In the initial days of trade, I had mentioned that I dont believe in return.

I never knew u dint had MCE. Before buying u should have done enough research. Since I have

already invested that money in a new device, i cannot even think of return

the seller himself reviewed elsewhere that the product is an incapable one in Jan 2009

& he exaggerated its capability here in Mar 2010 to sell it . This comes under IPC 420

if I was in his location then I'd have checked the product before buying . it would had

been my own fault if the product was found to be faulty after buying it in person ......

Now through this TE public forums , I request the seller once again to take back the product

and return my money ... He appears to be a Hardware expert and it is not expected from him

to exaggerate the quality of the product to sell & cheat . He certainly knew that the product

will not satisfy my requirements . He had reviewed the product that it is an incapable card .

yet he sold it saying " Be sure it will make you happy if you take full use of it " (18 March)

Avemedias own software i.e. Aver Tv and Aver Media centre will not detect this card

even after installing original drivers in Dell systems. Specially the FM radio will not work

though the original card from Aver has FM features

My appeal to the seller : Return my money and accept the product back .

@Seshu....if what u say is true then the seller is at fault here...

Did u preserve all the PM's that you and he exchanged?

No mate. The seller is not at fault. He never said the fm works or anything. And he didnt mention anything abt return. He is no way obligated.

Sorry mate, U made too much assumptions. Ur buying it u should have searched for all bfore buying it.

What he says in his profile cannot be taken for face value. And his review, when he is selling the product why would he mention tht. He didnt lie either. It was ur burden to re search. Before u buy it. No ipc can justify anything. All u can do is sell it to someone or request the buyer. It upto him.
 
@Mjeri: The seller lied straight up

Points:

  1. He gave a link to the Aver media site when he knew that the actual product was a stripped down version. He was fully aware yet he chose to misdirect the buyer.
  2. He kept on insisting that he was unable to try out the FM and he was not sure whether there was a FM present in the card. But the fact is he already knew that there was NO FM in the card
  3. He himself had reviewed the card and knewthat the drivers were not available anywhere but he gave the seller the link to dell stating that the drivers are available everywhere
  4. He knew it was a incapable card and couldn't be used yet he never revealed it. And anyone who does a research will stumble on the aver site which anyways gives incorrect specs:S

I know that its the buyers duty to do the research but if the seller misdirects from all aspects then the buyer will tend to believe the seller's assurances.

the Seller has lied on many counts here (if the buyers statement in post 1 is correct)

@ I think the buyer has put his case in a very exhaustive way.

4. now... how can this be sellers fault. its again upto buyer.

I NOW see what ur saying but still i can only see a buyer who hasnt done enough looking. He hasnt even made the seller quote the warranty terms. Seller DID avoid that very wisely and the seller accepted that.

I can only agree that the seller should return the money on the basis of ethic and morale. Not coz the buyer got a right to. He just didnt do anything at all. he took every word for value and just made assumptions.
 
Dude...Yup..Agree that the seller prolly has no obligation to return the money..

But there is one very underlying fact: The seller lied straight up. And the whole dealing methodology by the seller was very unethical...hiding clear facts

Not everyone is a techie and not everyone can do so deep research...The buyer did ask questions and tried to verify the sellers response (he verified the links that was given by the seller which looked ok)...

Buy and sell does rely on trust heavily on any forum or even in actual physical market.

The seller clearly broke the trust here by lying in multiple counts. Don't know if he can be asked to refund the money or found guilty because he lied...

But I think noone would want to deal with such a seller...

Again buyer is at fault for not confirming anything for sure. he just assumed.

Seller is at fault for misleading.

It is a pickle.

@M-jeri: That's what con men do...They sell useless stuff to ppl who get fooled into buying them. The would project the useless stuff to be of great value:).But police does take action on these conmen. Here, The police does not say that it was the buyers fault that he got conned:)

Well... Thanks to Seshu...I would now probably avaoid trading with absolutely anyone who has less than 100 posts/ 5 yrs maturity in the forum...

Ppl lying upfront is a new high:(that too as his age shows he is not a kid
 
he mised , you believed ....your bad...now he has a bad rep and he cant sell here again...but i dont think hes obligated in refunding you , you can always sell it on to someone else..... you just believed his advertising and you have learnt a lesson , trust noone

@ Kippu , I'd make the product into pieces instead of selling it to some other person :)
